Seigel’s experience in resolving business and commercial problems spans over three decades. He has successfully helped disputing parties in matters involving business transactions, professional liability disputes, commercial law matters, bankruptcy issues, real and personal property rights, intellectual property litigation, debtor-creditor rights, construction controversies and all aspects of real estate disputes. His approach to reaching consensus in the mediation process is driven by his determination to help each side understand not only their own reasons for achieving a resolution but helping each side understand the other side’s reasons for doing so. He views mediation as a complex series of negotiations in a relaxed and comfortable atmosphere and believes that even though litigants may be bitterly opposed to the other’s views as to right and wrong, a common understanding can be achieved that goes beyond the legal and factual issues involved. He often uses references to recognized and authoritative publications on business management as well as theological, biblical and Talmudic works to demonstrate that philosophy. Mr. Seigel is a graduate of the Mediation Skills Training Program of the Institute of Dispute Resolution at Pepperdine University School of Law. He has published numerous articles on legal matters including the practical aspects of mediation of business disputes. His article entitled, “Mediation of Bankruptcy Disputes: A Risk Assessment Lesson for Lenders” received wide acclaim following its publication in the February 2005 edition of the Thompson West Bankruptcy Litigation Reporter and the March 2005 edition of the Thompson West Bank & Lender Liability Litigation Reporter. His article “Mediation of Professional Liability Disputes” appeared in the March 2006 edition of the Los Angeles County Bar Update and contains guidelines for litigants and insurers to consider when resolving disputed claims. Another of his articles, “Valuation of Contingent Liabilities: Some Risk Management Considerations for Lenders” appeared in the September 2005 edition of the RMA Journal published by The Risk Management Association and demonstrates the type of detailed analysis he performs prior to addressing each matter in which he serves as the mediator. His article “Meltdown Mediation” was published in the winter 2010 edition of the American Bar Association’s Dispute Resolution Magazine. He has served as a mediator for the United States Bankruptcy Court for the Central District of California since 1995 and is the recipient of numerous awards for his service to the Court. Mr. Seigel is the founder and President of the American Mediation Association, Inc. He is a graduate of the University of Missouri, Columbia, Missouri, where he received his Bachelor of Science degree in Chemical Engineering in 1958. Mr. Seigel received his Juris Doctor degree, Cum Laude, in 1974 from the University of West Los Angeles School Of Law. He is admitted to the Bars of the State of California and the District of Columbia, and is admitted to practice in the United States District Courts in California, the Ninth Circuit Court of Appeals, the United States Tax Court, the United States Claims Court and the United States Supreme Court. He served as an Officer in the United States Navy (1958-61) aboard aircraft carriers, and as a collateral duty was Trial and Defense Counsel for Special Courts-Martial. From 1961 to 1974 Mr. Seigel was active in the textile and apparel industry. He was a member of the Board of Directors of the National Association of Textile and Apparel Wholesalers and of the Los Angeles Wholesale Institute. He is active in numerous charitable and civic organizations. Mr. Seigel served as an adjunct instructor at the University of West Los Angeles School of Law and Paralegal Studies in courses on legal theory and practice, contracts, torts, real property, business planning and bankruptcy. He is a frequent lecturer to accounting firms, financial institutions and other organizations on debtor/creditor topics and the financial and psychological benefits of resolving disputes through mediation.
