When Bullies Become Bosses

bulliesAccording to a recent study, more than 80 per cent of workplace bullies are bosses. Contrary to popular belief, bullies do not go after the weakest link, they tend to aim for the strongest. Bullies pick on capable, co-operative people they identify as a threat. Most victims do not realize they are being bullied because they aren't doing anything wrong and because a higher-up is doing it. Several recent cases show there are serious consequences for allowing the continuation of workplace bullying. Federal Minimum Wage Set to Rise

Employers should not forget that the federal minimum wage will increase to $7.25 on Friday, July 24. With this change, employees who are covered by the federal Fair Labor Standards Act (FLSA) will be entitled to pay of no less than $7.25 per hour. Rajiv Khanna Joins Virtual Faculty

rajiv2Washington, D.C. based immigration attorney Rajiv Khanna has joined the Avant Resources Virtual Faculty. Since 1993, he and his 40-person firm have focused their practice on employment and business-based immigration and related administrative and federal litigation. The firm's web site www.immigration.com is the oldest portal and compendium of immigration law. He will present "New Immigration Audits: Are You a Target?" on July 22.

 

 

Supreme Court Overrules Judge Sotomayor

The U.S. Supreme Court has over ruled Judge Sotomayor’s decision in Ricci v. DeStefano. The case arose when certain White and Hispanic firefighters sued the City of New Haven for improperly refusing to use the results of promotional exams that left too few minorities qualified for open Lieutenant and Captain positions. The City argued that because the results of the exam left no African Americans qualified for either position and only two Hispanics qualified for the Captain position, certifying and using the results would have exposed them to liability under Title VII for adopting a practice that had a disparate impact on minority firefighters. The Supreme Court concluded that the City's actions violated the disparate treatment prohibition of Title VII because it chose not to certify the examination results based solely on race.

 

Teamsters preparing for EFCA Passage

The Employee Free Choice Act may not be shaping up the way the Teamsters may have envisioned, but that’s not stopping the union. The Teamster recently announced they are seeking 1,000 new organizers to help them deal with the “deluge” of organizing requests they expect after EFCA passes. We expect to see a major push by labor’s supporters to pass some sort of EFCA-derivative legislation in the next several weeks. You can stay current on EFCA and earn 1.5 hours of continuing education.
